DAS Appeal Process Regarding Accommodation Determination Decisions

We invite students to have a discussion around a denial of a request for accommodation with their DAS Adviser prior to initiating the appeal process. Please contact the front desk at [email protected] to set up a discussion meeting.

Students who have been denied an accommodation can submit new information such as additional documentation or context and request that their access adviser reconsider the accommodation request. The student may submit the additional request through their DAS Student Portal. Reconsideration requests with new documentation or information may be brought to the DAS Advising Team meeting for review and committee decision.

If the student would like to appeal the denial and is not submitting new information nor additional documentation, the student should submit their appeal within five (5) days of the denial notification from DAS.

  1. The student should put in writing the reason for the appeal regarding a disability-related access need for the accommodation along with supplying relevant documentation. Please email [email protected].
  2. The student should then call (541)737-4098 to request an appointment with the Assistant Dean and Director or designee to discuss the appeal.
  3. During the discussion with the Assistant Dean and Director or designee, the student should be prepared to explain why the denied accommodation is needed to have disability access at OSU. Though considered as an element in the interactive process, having received an accommodation from a previous institution or in the K-12 system is not in itself, a sufficient rationale to determine that an accommodation is reasonable or warranted. Accommodations are active when approved and are not typically implemented retroactively.

The DAS Assistant Dean and Director or designee will make a decision regarding the student’s appeal within five (5) business days.  The decision will be in writing and will be sent to the student’s ONID email. This decision pertaining to whether an accommodation is required for disability access is considered to be final.

To express procedural concerns:

If the student has concerns about due process, the student may file an appeal with the Associate Vice President and Dean of Students within ten (10) business days of the DAS Assistant Dean and Director or designee’s determination.

The student must provide the Associate Vice President and Dean of Students with information that the student believes demonstrates they were not provided with due process by the DAS Assistant Dean and Director or designee or by Disability Access Services. This information needs to be emailed to [email protected].

The Associate Vice President and Dean of Students’ decision will be in writing and will be sent to the student’s ONID email. This is the final step: the Associate Vice President and Dean of Students decision is the university’s final decision on the matter.

To engage in the formal grievance process, the student may file a discrimination report with the Office of Equal Opportunity and Access (EOA).

Though engaging in OSU internal processes are strongly encouraged, a student may seek external assistance from the Office for Civil Rights (OCR).
